La Commodity Futures Trading Commission (CFTC) USA ha multato Bitfinex e Tether per oltre 42 milioni di dollari. L’accusa è che la stablecoin USDT non era sempre completamente garantita mentre Bitfinex ha violato un precedente ordine dell’agenzia.
Il regolatore federale dei titoli azionari ha multato le due compagnie crypto gemelle venerdì. Secondo la conferenza stampa della CFTC la stablecoin di Tether è stata completamente garantita da riserve solo per un un quarto del periodo in esame, 26 mesi dal 2016 al 2018. Inoltre, Tether ha sommato ai fondi di riserva quelli di proprietà della compagnia e in prodotti non liquidabili.
Si legge inoltre: “At various times, Tether maintained some of the Tether Reserves in bank accounts other than the Tether Bank Accounts. Tether represents that, at times, it also included receivables and non-fiat assets among its counted reserves; and further represents that Tether has not failed to satisfy a redemption request for tether tokens”.
L’ufficio del Procuratore Generale di New York ha riscontrato simili irregolarità durante le indagini su Tether e Bitfinex che sono state depositate all’inizio dell’anno.
Poco dopo la notifica dell’accusa da parte della CFTC, Tether ha contestato:
“As to the Tether reserves, there is no finding that tether tokens were not fully backed at all times – simply that the reserves were not all in cash and all in a bank account titled in Tether’s name, at all times. As Tether represented in the Order, it has always maintained adequate reserves and has never failed to satisfy a redemption request”.
Bitfinex pagherà 1,5 milioni di dollari ed è tenuto a istituire un “additional systems” per assicurare di non permettere in futuro altre violazioni nelle transazioni dei titoli.
In una dichiarazione, la Commissaria della CFTC Dawn Stump ha detto di essere d’accordo con le accuse formulate dalla Commissione, ma ha manifestato la propria perplessità sul fatto che debba essere questo l’istituto preposto a regolare in maniera specifica la materia delle stablecoin.
Stump ha messo in discussione la possibilità che la CFTC stia allargando la propria giurisdizione o di fatto intenda proteggere gli investitori.
